This agreement governs, for orders placed via hemmotor.com for products whose prices are shown in the Buy Electric Motors section, the rights and obligations between the seller and the buyer in accordance with the provisions of Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.

1. Parties

1.2. Buyer

The buyer is the natural or legal person placing the order. The buyer’s name/trade name, telephone number, billing and delivery details consist of the information provided by the buyer during the order and are included in the order confirmation.

2. Subject of the agreement

The subject of the agreement is the purchase by the buyer from the seller of the electric motor whose characteristics and sale price are shown on the website, and the delivery of the product by the seller. The product’s name, model code, quantity, unit price, payment method and total amount are shown in the order summary.

3. Placing and conclusion of the order

  1. The buyer selects the quantity and payment method on the product page, enters their contact details and sends the order via WhatsApp.
  2. The seller reviews the order; it informs the buyer of stock availability, delivery time and shipping cost via WhatsApp or e-mail.
  3. The agreement is concluded when the buyer, accepting that they have read this agreement and the Preliminary Information Form, gives the order confirmation and makes the payment. The order summary is sent to the buyer on a durable medium (e-mail or WhatsApp message).

4. Price and payment

  • Prices on the website are in Turkish lira; the list price excluding VAT and the amount including VAT are shown together.
  • For payments made by bank transfer / EFT, a 3% discount is applied to the list price.
  • Payment is made to the account below after the order confirmation. The buyer’s name / company name and the model code must be written in the payment description.

Once the order is confirmed, the price of that order is not changed. If a price contrary to reality has been displayed on the website due to an obvious typographical or system error, the seller may cancel the order by notifying the buyer; any amount collected is refunded.

5. Delivery and shipping

  • The product is shipped with one of the seller’s contracted freight or cargo companies to the delivery address specified in the order confirmation.
  • Shipping costs are borne by the buyer. The cost is notified to the buyer before the order confirmation and is not included in the sale price.
  • Delivery is made without exceeding the statutory maximum period of 30 days from the date the payment is credited to the seller’s account. For details, see the Delivery and Shipping page.
  • When receiving the product, the buyer should inspect the packaging; if it is damaged, a damage report should be drawn up together with the carrier’s staff.

6. Defective products and warranty

The products are covered by a warranty of 24 months from the date of delivery. In the case of a defective product, the buyer may exercise one of the optional rights under Article 11 of Law No. 6502 (withdrawal from the contract, price reduction, free repair or replacement with a defect-free equivalent). 7. Installation and use

The connection and commissioning of the electric motor must be carried out by a competent electrical technician in accordance with the applicable electrical installation rules. Failures resulting from incorrect connection, unsuitable supply conditions or failure to use protective devices are not covered by the warranty.

8. Personal data

The personal data provided by the buyer for the order are processed for the purposes described in the Personal Data Protection notice and in accordance with Law No. 6698.

9. Dispute resolution

A buyer who is a consumer may, for complaints and objections, apply to the Consumer Arbitration Committee at their place of residence or at the place where the transaction was carried out, within the monetary limits announced annually by the Ministry of Trade, and to the Consumer Court in cases exceeding these limits. Applications may also be made via e-Devlet. The courts and enforcement offices of İzmir have jurisdiction over disputes with buyers who are merchants.

10. Entry into force

Before confirming the order, the buyer accepts that they have read this agreement and the Preliminary Information Form. The agreement enters into force upon the buyer’s order confirmation.
